    Are police legally required to protect people in Canada? In the USA police are there to arrest criminals, NOT to protect you: 1) DeShaney v. Winnebago County Department of Social Services (1989): This case established that the government (and by extension, police) generally does not have a duty to protect individuals from harm by private actors unless there is a special relationship, like custody. The court found that the Due Process Clause did not impose an affirmative obligation on the state to protect someone from violence by another private citizen.

    2) Town of Castle Rock v. Gonzales (2005): In this case, the Supreme Court ruled that police do not have a constitutional duty to protect a person from harm, even in situations where a restraining order was in place that mandated arrest for violations. The ruling clarified that while there might be a general public duty to ensure community safety, there is no specific legal duty to protect individual persons unless a special relationship exists.
