PLASTIC LOVE IS BACK! – TFTI Update

A few months ago, I covered the disappearance of Plastic Lover’s viral upload of Mariya Takeuchi’s song Plastic Love due to a copyright dispute over the photo used. I am pleased to inform you that it is now back up! The situation has been resolved between Plastic Lover and the photographer Alan Levenson. Here is the sequence of events from the time my last video was made until now.

    “VARIETY”(1984) was MARIYA TAKEUCHI 's sixth original album, released in Japan on April 25, 1984.

    This album marked the first step of MARIYA TAKEUCHI , who took a break from her music activities at the end of 1981, but returned in earnest after getting married and taking her first steps as a Singer-Songwriter.

    All Songs were "Lyrics and music by MARIYA TAKEUCHI, arranged and produced by her husband TATSURO YAMASHITA ".

    I agree that Alan should have been credited, especially since it was not official album art and he was never compensated for it. I was very much on his side for that, but his writing to you was pretty rude. You told everyone that he was the one who made it and that he had not been compensated for it. Also, your usage fell under fair use. Kinda makes me less sympathetic towards him.

    I understand what he's going through. I've had people tell me directly that they were not going to credit me after using my art in their videos. It's a pretty awful feeling. How hard is it to put a timestamp with "art by XX" in the description of your video??? Still, you DID give him credit and your work was transformative. Not sure why he acted like it was a problem.

    It’s so sad that this was a positive story, only for the original Plastic Lover’s account to be taken down which means the original is gone again. ALONG WITH the reupload of the song that took the original’s place when it was taken down by Mr. Levinson. I respect his reasoning and I am not disrespecting him. I understand his motive and not realizing that claiming the video would take it down. I do, however, wish the Recording Industry Association of Japan didn’t copyright claim the reupload. It would not surprise me if they’re the people that got Plastic Lover/Gun’s channel taken down a few years back.

    Strange that his email to you mentioned that you were using his photo, as tho you were somehow out of line for doing so – your first video was clearly sympathetic with him and, as the photo was necessary for commentary, arguably falls under fair use

    Fast forward to NOVEMBER 2021 and they released a limited edition vinyl 45rpm single of Plastic Love for RSD Japan using THE photo!!!

    With “Cover Photo © Alan Levenson” on the back!!!
